I believe that you're getting your game and game engine and XNA Game Studio Express confused. When they are referring to the "software" in that liscense agreement. They are talking about XNA Game Studio Express.

So when they say you cannot "rent, lease or lend the software" they are saying you can't charge people money to use your copy of XNA Game Studio Express.

And when they say you can't publish the software for others to copy, they aren't talking about your games or game engine. They are saying you can't publish XNA Game Studio Express for others to copy.

Garage Games is a Microsoft Partner, so they can have special arrangements to do things that normal users of the software are not allowed to do.

I hope that clears some stuff up for you.
